General terms and conditions and liability

I. General

​

The following general terms and conditions apply exclusively to the business relationship between the trainer and the customer in the version valid at the time of the service.

II. Training and appointment scheduling

A training session lasts 55 minutes. The length of the training units for individual lessons may vary if a separate contract has been concluded between the trainer and the customer.
The training sessions take place in the trainer's premises (MOMAX PILATES Studio).
Appointments are only by appointment. The agreed appointments can only be canceled up to 24 hours before the start of the course. If you cancel later or miss an appointment, the full hourly fee will be charged.
All group lesson bookings can only be canceled via the app or website. Cancellation by email or telephone is not possible.

III. Liability and notices

​

The trainer is generally not liable for any damage suffered by the customer. This does not apply to liability for breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract and on whose compliance the contractual partner can regularly rely.
Liability for damage to the customer due to injury to life, body or health is excluded unless there is an intentional or grossly negligent breach of duty by the trainer or his vicarious agent.
The trainer is not liable for damages caused by the customer's overestimation of their own abilities. If the customer does not follow the trainer's instructions and suffers damage as a result, the trainer's liability is also excluded.

Liability for valuables and wardrobe is not accepted.

IV. Final provisions

​

Unless otherwise specified in these General Terms and Conditions, changes, additions and additional agreements must be made in writing to be effective. The written form requirement also applies to the waiver of this form requirement. If one of the existing provisions is ineffective or unenforceable, the effectiveness of the remaining provisions remains unaffected. Instead of the ineffective or unenforceable provision, a suitable, legally effective replacement provision that comes as close as possible to economic success will be made by mutual agreement.
